The purpose of the Town of Richmond Hill’s Sign By-law is to regulate the location, size, number and type of signs placed on properties and buildings in the Town. Generally, a permit is required for the placement of any sign within the municipality. However, certain types of signs are prohibited in the Town, while others do not require a permit.
If a proposed sign does not comply with the provisions of the Town’s Sign By-law, the property owner may submit a Sign By-law Variance application to the Town. The Town may authorize a variance if the proposed sign meets the general intent and purpose of the Sign By-law. In considering a variance, the Town shall have regard for:
a) special circumstances or conditions applying to the land, building, or use referenced in the Variance application;
b) whether strict application of the provisions of the Sign By-law in the context of special circumstances applying to the land, building, or use would result in practical difficulties or unnecessary and unusual hardship for the property owner that is inconsistent with the general intent and purpose of the Sign By-law;
c) whether such special circumstances or conditions are pre-existing and not created by the property owner, and
d) whether the sign that is subject of the Variance application will alter the essential character of the general area of premises in which the sign is proposed to be located, erected, or displayed.
